Welcome to the zawadi.paris website! This e-commerce site distributes cosmetic products for children and babies from birth. These terms of use constitute a legal contract between you and the company BOPMILA LABS. By using this website, you accept its terms of use. Otherwise, please do not use this website.
These general terms and conditions of sale apply to all orders placed on the zawadi.paris website.
The company BOPMILA LABS S.A.S reserves the right to adapt or modify these general terms and conditions of sale at any time. In case of modification, the applicable terms and conditions will be those in effect on the date of the order.
1. General Conditions: Acceptance and Application
The buyer acknowledges having read and accepted the General Terms and Conditions of Sale clearly set out by BOPMILA LABS S.A.S for its zawadi.paris site at the time of placing an order. These general terms of sale shall prevail over any other conditions appearing in any other document, except in the case of prior, express, and written exemption. The company BOPMILA LABS S.A.S is registered with the Paris Trade and Companies Register under the Siren number 935 287 730, and the buyer is defined below as the company or individual accepting these terms of sale. The buyer declares to have the legal capacity to enter into a sale under the conditions described below, i.e., to have reached the legal age of majority and not to be under guardianship or trusteeship.
Any validation of an order for products offered on the site implies the buyer’s express and prior consultation and acceptance, without restriction or reservation, of these general terms of sale. It is specified that the buyer can save or print these general terms of sale, provided they do not modify them.
BOPMILA LABS reserves the right to modify these terms and conditions at any time without prior notice, with the understanding that such modifications will not apply to reservations and orders previously accepted and confirmed by the buyer.
2. Order
The automatic recording systems communicated via the Internet are considered as proof of the nature, content, and date of the order. For online orders, BOPMILA LABS S.A.S confirms the acceptance of the order to the customer at the email address provided.
After reviewing their order status and once all the requested information has been completed, the buyer can confirm their order to proceed with payment. They will choose the payment method they wish to use, understanding that they must have access to the chosen payment method.
The sale will only be considered final after the buyer receives an order confirmation from BOPMILA LABS S.A.S via zawadi.paris and after the company collects the full payment. BOPMILA LABS S.A.S recommends that the buyer save this information in paper or electronic format. BOPMILA LABS S.A.S reserves the right to cancel any order from a customer with whom there is a dispute related to a previous order that is wholly or partially unpaid.
3. Prices
On our online catalog zawadi.paris, prices are shown in Euros, inclusive of all taxes applicable on the day of the order. Prices may change throughout the year; however, products are billed at the prices in effect at the time of order registration.
Shipping costs are not included in the prices and are charged in addition depending on the order amount, unless the invoice total meets the threshold for free shipping. Shipping fees will be displayed before the order is confirmed by the buyer.
4. Product Availability
In the event that a product is permanently unavailable after the order is placed, the buyer will be informed by email or phone about items that are out of stock. If no request is made by the buyer after this notice, the order will be shipped with the available items, and only those items will be billed.
Products are offered within the limits of available stock. If a product is unavailable, the buyer will be informed when viewing the product on the website. This information may also be communicated at various points: during order placement, order validation, or before delivery via email. BOPMILA LABS SAS will adjust the payment amount accordingly through the payment platform or refund the buyer via bank transfer if payment was made via wire transfer.
5. Delivery
BOPMILA LABS SAS will deliver the buyer’s order to the address provided. If the buyer provides an incomplete or incorrect address, they are responsible for the failure to deliver the order. If a package is returned due to an incomplete or incorrect address, reshipping costs will be charged to the buyer.
In case of failure to pick up the package from a designated point relay on time, the buyer will be responsible for reshipping fees.
BOPMILA LABS relies on external service providers for order delivery, and delivery delays may occur without BOPMILA LABS being held responsible for those delays or their consequences.
Upon product shipment, the order will be marked as “shipped” in Shopify, and the buyer will receive a tracking number via email to monitor their order.
6. Delivery Issues Due to the Carrier
Any anomaly regarding the delivery (missing product listed on the invoice, damaged package, broken products, damage, etc.) must be indicated on the delivery receipt as “written reservations,” accompanied by the customer’s signature. The customer must also confirm this anomaly by sending the carrier, within two (2) working days following the delivery date, a registered letter with acknowledgment of receipt detailing their claims. All our shipments are handled by La Poste. This service delivers within 48 hours across France and offers you the option to collect ordered products at your nearest post office if delivery to your address fails at the initial presentation by the postal worker. If you are absent on the delivery day, a delivery notice will be left in your mailbox, allowing you to collect your package at the post office during opening hours within 15 days. BOPMILA LABS S.A.S will not be held responsible for delays or losses caused by La Poste services. However, the buyer must notify us of such failures via email. 7. Merchandise Returns
We are committed to providing you with complete satisfaction for all our products. This right does not apply to products that are damaged, incomplete, without original packaging, used, or soiled by the customer. This right also does not apply if the customer fails to collect the package from a designated point relay within the specified time frame or fails to use the prepaid return label within the allowed period.
Packaging and reshipping costs to BOPMILA LABS S.A.S are the responsibility of the buyer, who must ensure the packaging is sufficiently durable to allow products to be received in perfect condition at BOPMILA LABS S.A.S facilities.
8. Right of Withdrawal
If the products are eligible for the statutory right of withdrawal, the buyer has a period of 14 days to exercise their right of withdrawal. The buyer may exercise this right by using the form accessible via the withdrawal link located in the footer of the website, or by any other unambiguous statement.
The buyer exercising their right of withdrawal may obtain a refund for the returned products as well as the standard delivery costs of the order, without undue delay and no later than 14 (fourteen) days from the date on which BOPMILA LABS is informed of the buyer's decision to withdraw. BOPMILA LABS may withhold the refund until receipt of the returned products or until the buyer has provided proof of shipment of the products, whichever occurs first.
The refund will be processed using the same payment method used by the buyer for the initial transaction.

9. Invoice Payment
Any customer placing an order will be responsible for its payment, even if the order is requested to be delivered to another address.
10. Accepted Payments

Payments are secured using a powerful universal encryption system. This SSL encryption guarantees that the bank card number entered is only known to our payment platform. BOPMILA LABS SAS will only process an order once the relevant bank payment centers have approved the transaction. If these centers refuse payment, the customer will be notified by email, and their order will automatically be canceled.

This contract is subject to French law. In the event of a dispute, the Commercial Court of Paris will have sole jurisdiction. BOPMILA LABS S.A.S cannot be held responsible for any damages of any kind, whether material, immaterial, or bodily, resulting from the malfunction or misuse of the products sold.
The liability of BOPMILA LABS S.A.S will, in any case, be limited to the amount of the order and cannot be invoked for minor errors or omissions that may remain despite all precautions taken in the presentation of the products.
